Please read these Terms of Service carefully before using the opentripkomodo.com website or making a booking. By accessing or using our services you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and PT Komodo Liveaboard Dwipantara, trading as OpenTripKomodo ("OpenTripKomodo", "we", "us", "our"), a company incorporated under the laws of the Republic of Indonesia, with its principal place of business in Labuan Bajo, Flores, Nusa Tenggara Timur, Indonesia.
By submitting an inquiry, making a booking, or using any part of the opentripkomodo.com website, including bookings continued on opentripkomodo.net, you confirm that you have read, understood, and agree to these Terms in full.
2. Services
OpenTripKomodo operates a curated open-trip platform offering sharing liveaboard trips, phinisi sailing, speedboat day trips, and private charters around Komodo National Park, departing from Labuan Bajo, Flores.
OpenTripKomodo is not a marketplace. We own the customer relationship end-to-end. While trip units may be fulfilled by vetted local partners, the customer deals exclusively with OpenTripKomodo for booking, communication, payment, and after-trip support. Customers have no direct contractual relationship with fulfilment partners.
All partners are reviewed and onboarded by our team. Standards of vessel condition, safety, and service are set and monitored by OpenTripKomodo.
3. Booking Process
Open trip bookings started on opentripkomodo.com continue on the boat pages of opentripkomodo.net, where payment is processed. Private trips and boat charters start with an inquiry via WhatsApp. Submitting an inquiry does not constitute a confirmed booking.
Upon receiving your inquiry, our team will review availability and send you a formal quote. A booking is confirmed only after:
- You have accepted the quoted price and terms.
- Payment has been received and confirmed by OpenTripKomodo: in full for open trips, or per the written payment schedule for private charters.
Payment is processed through DOKU, our licensed payment gateway, or by bank transfer to our official account. The binding price is always in Indonesian Rupiah (IDR).
4. Pricing
All prices listed on opentripkomodo.com are denominated in Indonesian Rupiah (IDR). Prices displayed in other currencies are converted at the prevailing exchange rate at the time of display and are indicative only. The binding price is always the IDR amount stated in your confirmed booking.
Prices are subject to change without prior notice. A price displayed on the website is not a guaranteed quote until a formal written quote has been issued by our team and a booking has been confirmed in accordance with Section 3.
Seasonal rates, public holiday surcharges, and special event pricing may apply. Any applicable surcharges will be clearly stated in your quote.
5. Payment Terms
Your booking is locked once payment is received. Typical structures are:
- Sharing open trip (liveaboard, phinisi): payment in full at confirmation through the official payment page. Nothing is billed afterwards.
- Speedboat day trip: full payment at confirmation.
- Private charter: payment schedule agreed in writing at time of booking.
Payment may be made by bank transfer to our designated account or via a DOKU payment invoice sent by our team. We do not accept cash payments arranged independently outside of these channels.
For private charters with a staged payment schedule, the booking is at risk of cancellation if the next instalment is not received by the agreed date. OpenTripKomodo will make reasonable efforts to contact you before releasing the booking.
6. Customer Responsibilities
As a customer, you are responsible for the following:
- Identification. You must present a valid national identity card (KTP) or passport at pick-up or boarding. Failure to provide valid ID may result in the trip being refused without refund.
- Arriving on time. You must be present at the meeting point per the confirmed schedule. Lateness may result in loss of the trip without refund, as sharing boats depart on schedule.
- Following safety instructions. You must follow crew and guide instructions throughout the trip, including the use of safety equipment during snorkeling or water activities.
- Reporting issues. Any issue or incident during the trip must be reported promptly to the crew and to OpenTripKomodo.
- Lawful use. Services must be used only for lawful purposes and in accordance with the rules applicable within Komodo National Park.
7. Cancellation and Refunds
Cancellation terms vary by trip type and lead time. Please refer to our How to Pay page for full details, including applicable refund timelines and amounts.
All cancellation requests must be submitted in writing via email to admin@opentripkomodo.net. Verbal cancellations are not accepted.
8. Limitation of Liability
OpenTripKomodo arranges trips through vetted local partners. While we maintain quality standards across our partner network, we are not the direct owner or operator of every vessel in our catalogue.
To the maximum extent permitted by applicable Indonesian law, OpenTripKomodo shall not be liable for:
- Consequential losses from force majeure, including but not limited to adverse weather, rough sea conditions, natural disasters, volcanic activity, government-imposed travel restrictions, pandemics, or civil unrest, such as forfeited flights or hotels. For the trip itself: if it cannot depart for such a reason, you get a full refund or can move your date, as set out in the How to Pay.
- Mechanical breakdown or failure of vessels beyond normal maintenance standards.
- Personal injury, damage, or loss arising from the customer’s own negligence.
- Loss or damage to personal belongings brought during the trip.
Insurance coverage varies by trip type. It is the customer’s responsibility to arrange adequate travel insurance for their trip.
Where OpenTripKomodo is found liable, our total liability shall not exceed the total amount paid by you for the specific trip giving rise to the claim.
9. Intellectual Property
All content on opentripkomodo.com, including but not limited to text, photography, illustrations, logos, brand marks, and software, is the exclusive property of PT Komodo Liveaboard Dwipantara or its licensed content providers. All rights reserved.
You may not reproduce, distribute, modify, publish, or commercially exploit any content from opentripkomodo.com without our prior written consent. Unauthorised use may constitute an infringement of copyright or trademark law.
10. Privacy
Your personal data is collected and processed in accordance with our Privacy Policy, which forms part of these Terms. By using our services you consent to the collection and use of your personal information as described therein.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any dispute arising from or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Labuan Bajo, Nusa Tenggara Timur, Indonesia.
12. Changes to These Terms
OpenTripKomodo reserves the right to update or amend these Terms at any time without prior notice. The updated Terms will be published on this page with a revised "Last updated" date. Your continued use of opentripkomodo.com or our services after any such changes constitutes your acceptance of the updated Terms.
We recommend reviewing this page periodically, particularly before making a booking.
